1. Acceptance of Terms

By registering for an account, accessing, or using HireSmart, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and Cookie Policy. If you do not agree, discontinue use immediately.

You must be at least 18 years old or the age of majority in your jurisdiction to use this Service. By using HireSmart, you represent and warrant that you meet these age requirements.

2. Account Types and Eligibility

2.1 Account Types

• Job Seeker: Individuals seeking employment opportunities
• Employer: Companies and organizations posting jobs and hiring candidates
• Agency: Recruitment agencies managing multiple clients and placements

2.2 Account Registration

You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your password and account credentials.

2.3 Account Security

You are responsible for all activities under your account. Notify us immediately at security@hiresmart.pro of any unauthorized access or security breaches. We are not liable for losses arising from unauthorized account use.

3. Subscription Plans and Billing

3.1 Subscription Tiers

HireSmart offers free and paid subscription plans with varying features, limits, and AI coin allocations. Current pricing available at hiresmart.pro/pricing. Job Seeker accounts are free forever.

3.2 Billing and Payments

• Subscriptions billed monthly in advance on billing date
• Payments processed via Razorpay, PayPal, or Stripe
• All fees in USD unless otherwise specified
• Automatic renewal unless canceled before billing date
• Failed payments result in 7-day grace period, then service suspension

3.3 Price Changes

We reserve the right to modify pricing with 30 days' notice. Existing subscribers maintain current pricing for one billing cycle after notification.

3.4 AI Coins

AI Coins are virtual currency for AI-powered features (pricing: 25 coins = $1). Purchased coins never expire. Monthly subscription coin allocations do not roll over. Coins are non-transferable and non-refundable except as required by law.

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use HireSmart lawfully and professionally. You will not:

• Post false, misleading, or fraudulent information
• Impersonate others or misrepresent affiliation
• Upload malware, viruses, or harmful code
• Scrape, harvest, or collect user data without authorization
• Circumvent security features or access restrictions
• Spam, harass, or abuse other users
• Post discriminatory, offensive, or illegal content
• Use automated bots or scripts (except approved API usage)

4.2 Content Standards

Job postings, profiles, and communications must be accurate, professional, and comply with applicable employment laws. Employers must not post discriminatory job requirements or engage in illegal hiring practices.

4.3 Enforcement

Violations may result in content removal, account suspension, or termination without refund. We reserve the right to investigate violations and cooperate with law enforcement.

5. Intellectual Property Rights

5.1 Platform Ownership

HireSmart platform, including software, design, code, logos, and content (excluding user-generated content), is owned by StartupStreet and protected by copyright, trademark, and intellectual property laws.

5.2 User Content License

By uploading content (profiles, resumes, job postings), you grant HireSmart a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for platform operation, matching algorithms, and service improvement.

5.3 User Content Ownership

You retain ownership of content you upload. You are responsible for ensuring you have rights to upload all content and that it doesn't infringe third-party rights.

6. AI and Neural Profiling

HireSmart uses AI algorithms for matching, recommendations, and neural profiling (IQ, EQ, SQ assessments). While we strive for accuracy, AI systems are not perfect. Results are estimates and should not be solely relied upon for employment decisions.

Employers using AI-powered candidate matching must comply with applicable employment discrimination laws and conduct their own candidate evaluation.

7. Data Privacy and Security

Your privacy is important. Our data collection, use, and protection practices are detailed in our Privacy Policy. By using HireSmart, you consent to data practices described therein.

We implement industry-standard security measures but cannot guarantee absolute security. You acknowledge risks of data transmission over the internet.

8. Third-Party Services and Integrations

HireSmart integrates with third-party services (LinkedIn, GitHub, Behance, payment processors). Your use of these integrations is subject to their respective terms. We are not responsible for third-party service availability, security, or content.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

HireSmart is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure service.

9.2 Employment Outcomes

HireSmart is a platform connecting job seekers and employers. We do not guarantee job placements, hires, or employment outcomes. All hiring decisions are between employers and candidates.

9.3 Limitation of Liability

To the maximum extent permitted by law, StartupStreet is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of HireSmart. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless StartupStreet from claims, damages, losses, and expenses arising from: (a) your use of HireSmart, (b) your content, (c) violation of these Terms, or (d) infringement of third-party rights.

11. Termination

11.1 By You

Cancel subscription anytime from Settings. Account access continues until end of billing period. Refunds subject to Refund Policy.

11.2 By Us

We may suspend or terminate your account immediately for Terms violations, illegal activity, or platform abuse, without refund. We may discontinue HireSmart with 30 days' notice.

11.3 Effect of Termination

Upon termination, your access ceases immediately. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

12. Dispute Resolution

Disputes shall be resolved through binding arbitration under applicable arbitration rules, rather than in court. You waive rights to jury trial and class action participation.

Before arbitration, contact legal@hiresmart.pro to resolve informally. This agreement is governed by laws of the jurisdiction where StartupStreet is registered.

13. Changes to Terms

We may update these Terms periodically. Material changes notified via email and dashboard 30 days before taking effect. Continued use after changes constitutes acceptance. Review Terms regularly.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and HireSmart
• Severability: Invalid provisions severed without affecting remaining Terms
• Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms. We may assign to affiliates or successors
• Force Majeure: Not liable for delays due to circumstances beyond our control
